EXPERIENCE PROVIDERS
TheHolidayExperiences® has Service Providers nationwide and is constantly adding venues and services offered. Should we need to change or withdraw venues or experiences due to circumstances beyond our control, comparable alternatives will be offered. In such circumstances buyers will be able to exchange their Theholidayexperiences Certificate® for a different experience of the same monetary value. TheHolidayExperiences® service providers have their own terms and conditions. By accessing TheHolidayExperiences® website, experience participants and experience providers are deemed to have accepted the terms and conditions presented. Experience providers may ask participants to sign an acceptance form or waiver and will be notified by the service provider when they use their Theholidayexperiences Certificate® or during the experience.
EXPERIENCE DESCRIPTIONS
TheHolidayExperiences® endeavours to keep all information about experiences as accurate and up-to-date as possible. However, the exact details of each experience may vary from time to time and from provider to provider. The most up-to-date experience descriptions can be found at www.theholidayexperiences. The images used in all TheHolidayExperiences® promotional materials are for illustrative purposes only and may not necessarily reflect the exact details of each experience. All legal responsibility for the visual content submitted to TheHolidayExperiences® lies with the Experience owners.
The duration of each experience is an approximation of the time the participant will spend at the venue. Details regarding the number of participants or waiting time are listed in the experience description where possible. Once the experience has been purchased, a booking confirmation confirmation will be sent to the experience owner and then the experience owner will receive the booking confirmation letter for the relevant experience and theholidayexperiences® Certificate confirmation.
EXPERIENCE REQUIREMENTS
It is the participant’s responsibility to comply with all necessary conditions of the experience as stated on TheHolidayExperiences® website and/or in the ‘Experience Booking Confirmation’. Some experiences may be restricted by factors such as, but not limited to, age, height, weight or health and the like.
Experience descriptions will describe as accurately as possible the limitations or requirements associated with each experience. Participants may lose the full value of their Theholidayexperiences® Certificate if they are unable to attend on the day allocated for the experience or are forced to cancel their experience booking after it has been scheduled because these requirements have not been met.
DRESS CODE
Some Service Providers recommend or require that certain clothing and/or footwear be brought to or worn for an experience. Alternatively, some Service Providers restrict certain clothing and/or footwear from being worn for an experience. Please ensure that you comply with these requirements before travelling for the experience. Theholidayexperiences® will not be held responsible if an experience cannot be provided due to the Participant not bringing or wearing the required clothing and/or footwear. In such cases the booking cannot be rescheduled and the original Theholidayexperiences® certificate value will be forfeited.
AVAILABILITY, BOOKING REQUESTS AND CONFIRMATIONS
Booking requests for Theholidayexperiences Certificates® must be made with Theholidayexperiences® and must be received at least two (2) days in advance unless otherwise stated within the experience. For weekends or holiday periods and/or experiences with limited availability, we recommend that booking requests be sent four (4) days in advance. Theholidayexperiences® is in no way responsible for appointments made directly with any Service Provider.
Whilst we will make every effort to meet the needs of all Theholidayexperiences®Certificate® Users, Theholidayexperiences® cannot guarantee a booking for an experience on a selected day or time. Once a booking request for an experience with Theholidayexperiences® has been made, it is the responsibility of the Redeemer of the Certificate to monitor the request via the contact details provided by the Redeemer at the time of the request.
Theholidayexperiences® Certificate Holder will receive a written confirmation by email (or other method deemed necessary) once the booking has been confirmed. The Beneficiary will receive an Experience Booking Confirmation which must be taken with the participant on the day of the experience and given to the Service Provider.
If the Participant fails to provide the Experience Booking Confirmation, the Service Provider is not required to provide the booked services. In such cases, the experience(s) cannot be rescheduled and the original Theholidayexperiences® Certificate® value will be forfeited.
The Experience Booking Confirmation can be accessed from theholidayexperiences® website www.theholidayexperiences.com ® from the theholidayexperiences® Certificate® User’s online personal account.
If for any reason the Experience Booking Confirmation is not received via email (or any other method deemed necessary) and is not accessible in the theholidayexperiences® Certificate® User’s online personal account, it is the User’s responsibility to contact theholidayexperiences® at least two working days before the earliest requested participation date.
Occasionally, Users may be asked to return a TheHolidayExperiences® Certificate® to Theholidayexperiences® prior to receiving a booking confirmation. Please do not make any travel or other related arrangements until the experience booking request has been confirmed by Theholidayexperiences®.
The confirmation of the experience booking will state how many days prior to the scheduled booking it is necessary to wait for the date and time of the booked experience to be confirmed. No changes, including cancellation, can be made to the reservation after making a purchase. Changes to booked experiences before the stated deadline are subject to a fee charged by Theholidayexperiences® and/or its Service Providers. The amount of these charges will be communicated as far as possible prior to the booking request.
Reservations cancelled by the Participant or Service Provider can only be rescheduled within 5 days of the original booking date.
After purchase, the official Experience Booking Confirmation is presented to the User of TheHolidayExperiences®. Bookings for unsupervised experiences cannot be rescheduled and the value of the original TheHolidayExperiences® Certificate® will be forfeited.
TheHolidayExperiences® Certificates® cannot be exchanged once the experience has been booked.
In limited circumstances, an experience confirmed by a Theholidayexperiences® Service Provider may need to be cancelled by the Service Provider.
In such circumstances, TheHolidayExperiences® is not responsible for any costs incurred by the Participant(s), including travel or other related arrangements. Participants will be able to reschedule experiences cancelled by Theholidayexperiences® or its Service Providers.
Theholidayexperiences® and its Service Providers reserve the right to substitute certain elements of the experience should these elements change or become unavailable due to circumstances beyond our control.
Due to the nature of many experiences, participation may be weather dependent. The experience description and booking confirmation will include advice on weather-related cancellations by the Service Provider. It is the responsibility of the Participant(s) to confirm their booking with the Service Provider in the event of any weather related issues or queries on the day of booking. The provision of the experience is at the sole discretion of the Service Provider. Participants will be able to reschedule experience(s) cancelled by the Service Provider due to weather-related issues.
Unattended bookings for organised experiences cannot be rescheduled and the value of the original Theholidayexperiences® Certificate(s)® will be forfeited. Theholidayexperiences® Certificates® cannot be exchanged or refunded once the experience has been booked.
THE HOLIDAY EXPERIENCE CERTIFICATE® CONDITIONS
Theholidayexperiences Certificate® is proof of payment. The Refund Reference found on the Theholidayexperiences Certificate® will be used to identify holders of Theholidayexperiences® Certificates® in all communications with Theholidayexperiences® Theholidayexperiences® Certificates® cannot be exchanged and must be presented intact on the day of the scheduled experience.
If Theholidayexperiences ® Certificate is not received within (3) calendar days of purchase, it is the responsibility of the Recipient to contact Theholidayexperiences ®. Theholidayexperiences ® Certificates cannot be reissued.

EXPERIENCE CERTIFICATES
Theholidayexperiences® Certificates® valid for a specific experience are used only for that experience.
DISCOUNTS AND SPECIAL OFFERS
From time to time may organise discounts or special offers on the purchase of certain TheHolidayExperiences ®Certificates. Only one (1) discount or special offer may be applied to an order.
The validity of discounts or special offers advertised on third party websites is not guaranteed.
All discounts or special offers must be applied at the time of purchase and cannot be applied to previously placed orders. Discounts and special offers are only valid for the period of time advertised by TheHolidayExperiences ®.
RETURNS
TheHolidayExperiences® does not issue any refunds or refund any payment transactions.
COMPLAINTS
Problems with the experience are best addressed on the day. Therefore, in the event of any issues or complaints, please notify the Service Provider immediately so that they have the opportunity to address the issue(s). TheHolidayExperiences ® also expects the participant to provide us with details of the complaint as soon as reasonably possible after the experience.
OTHER TERMS AND CONDITIONS
TheHolidayExperiences ® is independently owned and operated. TheHolidayExperiences® Service Providers are individually responsible for their health and safety standards and operating practices. TheHolidayExperiences® therefore makes no guarantees as to the consistency or effectiveness of individual Service Providers.
TheHolidayExperiences ® accepts no liability and shall not be liable for any loss, injury, claim, cost, damage or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind, whether in contract, tort, strict liability or otherwise, arising out of or in any way connected with (a) the use and redemption of this certificate or (b) the performance or non-performance of any Service Provider, even if all parties have been advised of the possibility of loss.
Under no circumstances shall Theholidayexperiences® be liable for any delay or failure of performance caused directly or indirectly by acts of nature, forces or causes beyond its reasonable control.
By exchanging TheHolidayExperiences® Certificate® for the Service(s), the Recipient, Beneficiary and/or Participant agrees to all Terms and Conditions stated at the time of service and releases Theholidayexperiences® from any and all liability for any loss, injury, claim, cost or damage of any kind whatsoever directly or indirectly connected with the chosen experience.
If any provision of this Agreement is found to be invalid or unenforceable in any respect, the validity and enforceability of the remaining provisions shall not be affected. All typographical errors are subject to correction. TheHolidayExperiences ®’s failure to enforce any provision of the Agreement at any time shall not be construed as a waiver of such provisions or of TheHolidayExperiences ®’s right to enforce such provisions in the future. The Buyer, the Rescuer and/or the Participant may not assign any rights under this Agreement without the written consent of TheHolidayExperiences ®. The Buyer, the Buyer, the Rescuer and/or the Participant shall not be entitled to set off any amounts due in respect of a transaction for claims under any other transaction with TheHolidayExperiences ®.
All disputes arising under this Agreement shall, if not earlier resolved, be resolved by the competent courts in the City of Antalya in Turkey and the Buyer, Rescuer and/or Exhibitor irrevocably submit to the exclusive jurisdiction of such courts. These Terms and Conditions are subject to change.
DEFINITIONS
Buyer
The buyer is the person who completes the financial transaction with TheHolidayExperiences®. An electronic receipt will be issued to the buyer at the time of the transaction.
Service Provider
Service provider is any company, individual or group of individuals engaged in the provision of experiences or related materials as determined by TheHolidayExperiences®.
Recipient
The recipient is the person or persons designated by the recipient to participate in the experience.
Saviour
The Beneficiary is the person or persons requesting a booking for an experience with TheHolidayExperiences® Service Provider for a service date(s).
Participant
The participant is the person or persons involved in the experience.
